Judge's Testimony implies Morrison Collusion in PP Corruption

Yesterday, in Judge Tatum's court in Johnson County, District Attorney Phill Kline presented evidence to show that Planned Parenthood's lawyers may have a conflict of interest in representing Planned Parenthood in Kline's case against Planned Parenthood.

The hearing was valuable for uncovering actions indicating Sebelius' hand-picked AG, Paul Morrison, gravely misused his office both to help Planned Parenthood avoid prosecution, as well as to hide all his court maneuverings on their behalf. (Court filings on these matters have been unjustifiably "sealed" from public scrutiny since at least June).

Judge Richard Anderson of Topeka was a witness in the hearing and his testimony indicates Morrison actively engaged in a coordinated campaign with Planned Parenthood to reclaim papers from Anderson --papers that police handwriting experts had told Anderson were forged.

Among other things, Judge Anderson testified that he found (from evidence Kline presented as AG over a two day hearing in 2004) probable cause to believe crimes had been committed by abortion clinics. He also said that "Morrison probably should not have issued a clearance letter" to Planned Parenthood (last summer.)

The judge's remark about the clearance letter was based on his testimony that state abortion reports which Planned Parenthood gave to his court appeared to have been falsified. The judge wasn't asked and thus didn't say if he suspected Morrison's work to help get Planned Parenthood's records back was based on Morrison knowing the records had problems, but it certainly begs the question--especially given that Morrison filed a mandamus action against the judge after he refused to hand over the records. It would also help explain Morrison's motivation regarding Linda Carter's claim that Morrison repeatedly tried to get her to find out information about Kline's case.

Of course, Kansas Governor Kathleen Sebelius has not questioned Morrison's actions. Instead she has done a Vogue Magazine photo shoot for their February issue, and allowed a man who has clearly abused his office an extra 40 days in which to do so. (Vogue Magazine's January issue features an article defending partial-birth abortion.)

All this gives us every confidence that the Governor's appointment of Morrison's replacement will be someone similarly charged with enforcing her political agenda over and above the Kansas late-term abortion law so despised by Planned Parenthood and top Kansas Democratic financier, late-term abortionist George Tiller!

Kansas law stipulates that every late abortion have a report made about it to the Kansas Department of Health and Environment (KDHE).

After Judge Anderson got the medical records he subpoenaed, he assigned special counsel Stephen Cavanaugh to protect their privacy and make sure they were completely redacted of identifying information. Cavanaugh made it crystal clear in court today that he did just that.

Judge Anderson had two doctors to review the records. The doctors noticed that the KDHE reports were not turned in by PP with the medical records. Kansas law stipulates that copies of these reports be kept in the medical records.

At that time Planned Parenthood was informed that the KDHE reports were missing and instructed to turn them in. They did, but evidently they did not turn in copies of the originals sent to the state, perhaps because they failed to keep a copy of the originals in their medical records, as required by law. They apparently did turn in what looked like copies, but upon inspection were deemed to be newly and falsely made up reports. In other words, PP told the court they were copies of the originals, but apparently weren't.

Judge Anderson testified that he was so concerned about the discrepancy with the records produced by Planned Parenthood that the Judge, on his own, asked a Topeka Police Department handwriting expert to review the records. The expert concluded the records "don't match up."

Last summer Morrison asked Judge Anderson for the PP files back. Not long after that, Planned Parenthood's lawyer showed up at Judge Anderson's office to get the files, but the judge, after having become suspicious of the records, refused to turn them over.

Morrison then did something pretty insulting, nervy and unprecedented. He filed a mandamus action against Judge Anderson.

Morrison apparently thought he was elected to protect Planned Parenthood rather than the public, and indeed he was! We have a document showing that Planned Parenthood had phone banks at their offices during the last election, but they deny that they made phone calls encouraging people to vote for Morrison. (Perhaps they were making phone calls to elect Kay O'Connor!)

Yesterday's testimony also indicated that the Planned Parenthood reports showed that they didn't do tests for viability on babies 22 weeks or more in gestation, as is clearly required by law, and that they decided that 24 weeks was more to their liking. Certainly Morrison had to know that too!

Judge Tatum said Kline could proceed to schedule the preliminary hearing for the felony charges. That hearing is predicted to take place in March or April. At that time Kline must present evidence sufficient for the judge to find the case should go to trial. In summary, for the first time I am aware of, a sitting District Court Judge (Anderson) testified that there were serious discrepancies with the Planned Parenthood documents, that a handwriting expert confirmed the problems, and that Morrison should not have issued the clearance letter to them. This is strong stuff.

Planned Parenthood won the motion in that their attorneys are still allowed on the case. But by bringing it up now, Kline got the Judges testimony public, and he prevented Planned Parenthood from later claiming their attorneys had a conflict and delaying the trial, or later challenging any conviction on that ground.

Not delaying the trial is key as these 2003 records have a five year statute of limitations and they will begin to time out, one by one, starting in July of THIS YEAR!

There appear to be more layers of secrecy and corruption covering up the Morrison/Planned Parenthood/Sebelius/Tiller affair than sewn into the designer gowns the governor modeled for Vogue Magazine!
